Terms of Service

1. Acceptance of Terms

By accessing or using Imutabl ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not access or use the Service.

2. Description of Service

Imutabl is a decentralized social platform where users can create, publish, and collect posts as non-fungible tokens (NFTs) on the blockchain. The Service allows creators to mint their content on-chain, set editions, and receive royalties on secondary sales.

3. Account Registration

You may need to create an account to access certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 13 years old to create an account.

4. User Content

You retain ownership of any content you create and publish on Imutabl. By minting a post, you represent that you own or have the right to mint the content as an NFT. You are solely responsible for the content you publish and its compliance with these Terms and applicable laws. Content that violates our Content Standards may be removed, and accounts may be suspended or terminated.

5. Content Standards

Imutabl is intended for appropriate, non-exploitative creative and social content. You may not post, mint, link to, promote, or otherwise distribute content that includes or depicts:

• Nudity or NSFW material — including sexual content, pornography, or sexually explicit imagery or audio
• Guns and weapons promotion — including content that glorifies, sells, or instructs on illegal use of firearms or weapons
• Drugs — including content that promotes, sells, or instructs on illegal drugs or controlled substances
• Hate speech — attacks or demeaning content targeting people based on race, ethnicity, national origin, religion, caste, sex, gender, gender identity, sexual orientation, disability, age, or similar protected characteristics
• Violence — graphic violence, gore, or content that threatens, glorifies, or encourages real-world harm
• Discrimination — content that advocates unlawful discrimination, exclusion, or harassment of individuals or groups

We may remove violating content, hide it from feeds, restrict minting or marketplace features, and suspend or terminate accounts. Because minted NFTs live on public blockchains, Imutabl may not be able to erase on-chain records even when we remove off-chain copies or restrict access on the Service.

6. NFTs and Blockchain

Minted posts are represented as NFTs on a public blockchain. Transactions on the blockchain are irreversible. Imutabl does not guarantee the value, liquidity, or marketability of any NFT.

Gas fees (also called network fees) are charges required by the blockchain network to process on-chain actions such as minting, transferring, listing, bidding, collecting, approving tokens or collections, and settling sales. On Imutabl these actions run on Base, and gas is paid in ETH on Base from your wallet to the network—not to Imutabl as a marketplace fee. Gas amounts change with network congestion and how complex the transaction is. A failed or reverted transaction may still consume gas. You are solely responsible for keeping enough ETH for gas and for any gas costs you incur.

Imutabl charges a marketplace protocol fee of 1% of the sale total on secondary sales completed through the Imutabl marketplace (including fixed-price listings, accepted offers, and settled auctions). This fee is deducted from sale proceeds before creator royalties and seller payout. The buyer pays the listed or offered price; the fee is not added on top of that price.

7. Royalties

Creators may set royalty percentages on their minted content. Imutabl will make commercially reasonable efforts to enforce on-chain royalties on secondary sales, but cannot guarantee enforcement on third-party platforms or protocols.

8. Prohibited Conduct

You agree not to:

• Violate the Content Standards in Section 5
• Publish content that infringes on the intellectual property rights of others
• Engage in fraud, manipulation, or deceptive practices
• Attempt to exploit, hack, or compromise the Service
• Use the Service for any unlawful purpose
• Create multiple accounts for the purpose of manipulation
• Harass, threaten, or abuse other users
• Upload malware, spam, or scrape the Service in a way that harms performance or other users

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. Imutabl does not guarantee uninterrupted access, security, or error-free operation. Use of the Service is at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law, Imutabl shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice — including for Content Standards or Prohibited Conduct violations. We may use pseudonymized security signals (such as non-identifying representations of IP addresses and device identifiers) to investigate and enforce these Terms. We do not store raw MAC addresses or raw IP addresses in our audit logs. Upon termination, your right to use the Service will immediately cease.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
